Little Known Facts about Georgia DUIs
- Most people think that DUI applies only to driving drunk. You can be charged with DUI for driving under the influence of anything---including your prescription medication. All the police have to prove is that the drugs impaired your ability to drive.
- You can still be convicted of DUI even if your blood alcohol is below .08 (the legal limit). This is called a “less safe” violation. The prosecution witness, usually the arresting officer, will have to testify that he or she saw you driving erratically. The officer can also testify to smelling alcohol on your breath, noticing watery eyes and hearing slurred speech.
- Georgia is a “Zero Tolerance” state. If you are caught drinking and driving and you are under the age of 21, you are violating the DUI law even if your blood alcohol level is only .02%. For commercial drivers, you can be convicted if your blood alcohol level is .04 %.
