Field Sobriety Testing
Since 1977 three field sobriety tests have been used:
- The One Leg Stand: This could be difficult to do even sober if you have difficulty balancing.
- The Walk and Turn: Can you walk a straight line and turn around and do it again? This is difficult if you are overweight, older or if you have limited eyesight.
- The Horizontal Gaze Nystagmus: This is characterized by a jerking movement noticed in the eye. This is the only test considered to have scientific merit. But about 100 other conditions not related to alcohol can cause this condition.
A good attorney will ask the following questions:
- Were the tests conducted according to the standards established by the Georgia Peace Officers Standards and Training Council?
- Are there medical conditions that could have caused the arrestee to fail the test?
- Was it cold, raining or cloudy when the test was given?
